1. Acceptance of Terms
By accessing this platform, downloading any free sample, or purchasing any dataset, you agree to be bound by these Terms of Service. If you do not agree, do not use this platform or its products.
2. What You Are Buying
WITNESS DATA FACTORY™ sells 100% synthetic clinical text datasets. All records are artificially generated. No real patient data, PHI, or PII is included in any dataset sold or distributed by this platform.
Datasets are delivered digitally via secure download link. Delivery is typically fulfilled within minutes of successful payment.
3. License Grant
Commercial datasets (paid tiers): Upon purchase, you receive a non-exclusive, non-transferable license to use the dataset for internal AI/ML research, development, training, and benchmarking purposes within your organization.
Free 1K samples: Distributed under the Creative Commons CC BY 4.0 license. Attribution required.
4. Prohibited Uses
You may not:
- Resell, sublicense, or redistribute purchased datasets to third parties
- Use datasets as the basis for clinical diagnosis, treatment, or medical decisions without independent validation
- Represent synthetic data as real patient records
- Use datasets to train models intended to deceive or harm
- Reverse-engineer datasets to produce derivative synthetic datasets for commercial redistribution
5. No Warranty
Datasets are provided "as is" for AI/ML research and development purposes. WITNESS DATA FACTORY™ makes no warranty that datasets are suitable for clinical use, regulatory submission, or any purpose requiring real-world medical validation.
Quality metrics (TAS ≥ 0.97) reflect internal synthetic quality scoring, not clinical accuracy guarantees.
6. Limitation of Liability
To the maximum extent permitted by law, WITNESS DATA FACTORY™ and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from use of or reliance on any dataset purchased or downloaded from this platform.
7. Refund Policy
Because datasets are digitally delivered and immediately accessible upon purchase, all sales are final. Exceptions are made only for verified delivery failures. Contact us within 48 hours of purchase if your dataset was not delivered.
8. Intellectual Property
All datasets, documentation, and platform content are the intellectual property of WITNESS DATA FACTORY™. The platform name, logo, and "Trinity" quality system are proprietary marks. Nothing in these terms transfers ownership of any intellectual property to you.
9. Governing Law
These terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles.
10. Changes to Terms
We may update these terms periodically. Continued use of the platform after changes constitutes acceptance of the revised terms. Material changes will be reflected in the effective date above.
